Criteria for Designating Enterprises as Critical Have Been Updated: What's Changing for the Construction Industry
The State Agency for Infrastructure Restoration and Development of Ukraine announced an update to the criteria for identifying enterprises that are critical to the functioning of the national economy and to ensuring the basic needs of the population during a state of emergency, as well as sector-specific criteria for enterprises in the construction industry.
What Has Changed at the Level of the Cabinet of Ministers
The government has amended the criteria for identifying critical enterprises and the procedure for reserving employees subject to military service.
Effective September 1, 2026, for employees subject to military service who are included by their employer on the reservation lists, the minimum amount of accrued wages must be three times the minimum wage.
Based on the current minimum wage (8,647 UAH), this amounts to 25,941 UAH. Previously, a multiplier of 2.5 times the minimum wage was used.
What changes have been implemented by the Ministry of Development?
The Ministry of Community and Territorial Development of Ukraine has updated the sector-specific criteria for identifying enterprises that are of significant importance to the national economy in the construction sector.
For companies engaged in new construction, reconstruction, restoration, major repairs, and technical modernization of facilities in specific infrastructure sectors, including:
- A minimum headcount has been established— at least 20 insured employees who were paid wages for the most recent reporting calendar month;
- The requirements for contracts confirming compliance with industry criteria have been clarified. Specifically, a company must have at least two valid contracts entered into no earlier than 60 days prior to the date of application, each with a project duration of at least six months and a contract value of at least 3 million UAH;
- A requirement has been introduced for documentary evidence of the consequence (liability) class of CC2 and CC3 construction projects.
